Sam Faulkner has been involved in over 250 law suits involving law enforcement and corrections from around the country relating to all response levels on the continuum. He has been involved in ninety or more suits relating to the use of a firearm response on the part of an officer. Surveying thousands of civilians and being in front of numerous juries, Mr. Faulkner has been able to get a pretty good idea of what people consider to be "objectively reasonable." Mr. Faulkner has spoken to and surveyed, civilian review boards, high school and college government classes, Rotary and Kiwanis Clubs, Optimist Clubs, Emergency Managers, etc., even some chapters of the ACLU. This collective knowledge has been put to good use in the formulation of the Action - Response Continuum. This works continues and grows with the surveying of civilians as well as Police Officers, Correction Officers Private Security and the Military at www.responsetoresistance.com
A year ago Sam was speaking at a major statewide symposium. After he was done presenting the next presenter, a sergeant from a major city police department came to the podium and stated, "Before I get started, I would personally like to thank Sam Faulkner, it is his research that enabled us to beat the Justice Department. The Justice Department had been examining this city in relation to allegations of "excessive force," with the very real possibility of placing them under a decent decree. Through the data collection available through the RTR Tracking Program, this department was able to document every police/citizen contact. They were able to prove that force was only used or threatened to be used in a miniscule number of these contacts and every time force was used, it was examined by supervisors to be sure that it was within departmental policy. The RTR Tracking Program also captures all of the critical information that will be vital if a law suit is filed. If the necessary details are not captured at the time of the incident, a year or more later when the Complaint arrives at the department, the facts are lost forever. Now, this type of attention to detail tool is available and extremely affordable for even the smallest department. You do not to be a large department with your own full time IT division.
The courts have held that it is not sufficient just to conduct physical subject control training. Departments must also hold class room training of force issues, constitutional issues relating to the control and arrest of subjects and policies and procedures revolving around these areas. Mr. Faulkner is available to come to your department to conduct this vital training. His Liability Risk Reduction lectures are informative, stimulating and thought provoking. He will leave your officers with a much stronger and deeper upstanding of subject control issues and the Courts requirements. Agencies wishing to host this training will be given special considerations for their hospitality. Let Mr. Faulkner's knowledge and experience work for you to reduce and manage your liability risk exposure.
